Terms of Service for Sapiens Wearable Programs
Last updated: 29 October 2026. These terms apply together with our Data Privacy Policy for Sapiens Wearable Programs.
1. Who we are and what these terms cover
Sapiens Health & Performance GmbH, Dinxperloer Straße 365, 46399 Bocholt, Germany ("Sapiens", "we") runs wearable-based habit-change programs, such as the 4-month Energy Management Journey (the "Program").
These terms govern your participation in the Program as a participant ("you"). If your employer or another organisation (the "Customer") booked the Program, the contract between the Customer and Sapiens governs fees, scope and invoicing. These terms govern your own use of the Program. If you booked the Program yourself, our general Terms & Conditions also apply, including your statutory rights as a consumer.
By registering for the Program, you accept these terms.
2. The Program
The Program helps you build habits for recovery, movement, nutrition and mental energy over 4 months. It includes a virtual kick-off, monthly virtual team sessions, short personal habit messages and, if you opt in, a wearable.
The Program is a lifestyle and wellness service. It is not a medical service. Section 9 explains what this means for you.
3. Who can take part
- You must be at least 18 years old.
- You take part on invitation of a Customer or by booking the Program yourself.
- Taking part is voluntary. In employer programs, declining or leaving has no consequences for your employment.
- You can take part under your personal six-letter code instead of your name.
4. Wearables
4.1 Provided wearables
- If you opt in to a provided wearable, Sapiens lends it to you for the duration of the Program. It remains the property of Sapiens.
- Please wear it as intended, keep it charged and treat it with normal care.
- At the end of the Program, return the wearable as described in the return instructions Sapiens sends you.
- If a provided wearable is not returned after several reminders, or is lost or damaged beyond normal wear, Sapiens charges 250 EUR for it. In employer programs, Sapiens charges this amount to the Customer.
- If you want to keep the provided wearable, you can buy it for 250 EUR, paid personally to Sapiens.
- Warranty and technical defects of the device are handled through the manufacturer's warranty process, where the manufacturer supports your country. Sapiens helps you with this.
4.2 Your own wearable
If you use your own wearable, for example a Garmin or Whoop, it stays your property and your responsibility. Your contract with its manufacturer is not affected by the Program.
5. Connecting your wearable data
- You create your own account with the wearable provider (for example Oura, Garmin or Whoop) and accept the provider's own terms and privacy policy.
- You connect your data to the Program through the provider's official sign-in (OAuth). You choose which permissions you grant, and Sapiens uses each permission only as described in the privacy policy.
- You can disconnect at any time in your wearable account settings or by telling us. Sapiens then stops processing your wearable data immediately.
- Sapiens does not claim ownership of your wearable data. Sapiens uses it only to deliver the Program to you. It never sells it, never uses it for advertising and never uses it to train or improve AI models.
- Oura, Garmin and Whoop are independent companies. They do not endorse, sponsor or operate the Program.
6. Messages and support
- Sapiens sends you short habit check-ins and, if you have connected a wearable, proactive check-ins based on your trends. Messages go by SMS, iMessage, WhatsApp or email, depending on the channels your Customer allows and your choice.
- You can change the channel or how often you hear from us at any time. Reply to any message or write to support@be-sapiens.com.
- Sapiens does not send you advertising or marketing messages as part of the Program.
- You can message your coach for support during the Program. Support is offered on a fair-use basis.
- Your mobile provider may charge for messages or data under your own plan.
- Messages are not monitored around the clock and are not an emergency service.
7. AI support
Sapiens may use an AI model running in the European Union to help write habit messages and answer your messages. The AI never receives your name, contact details, employer or wearable data. A human coach remains responsible for the Program. AI-supported messages are general wellness suggestions. They can contain mistakes, so please use your own judgement. If you prefer messages without AI support, tell us.
8. Team sessions and team dashboard
- Team sessions run virtually, on Microsoft Teams by default. Sessions are not recorded.
- In groups of more than 8 participants, your coach can screen-share an anonymised team dashboard with group values only. You decide whether your data is included. The dashboard never shows individual values or names.
- Please treat what colleagues share in team sessions as confidential. Do not record, photograph or share session content or the dashboard outside the session.
9. Wellness program, not medical care
- The Program does not diagnose, treat, prevent or monitor any disease. It does not replace medical advice, diagnostics or treatment.
- Wearables are consumer wellness devices. Their scores are estimates and can be inaccurate.
- Sapiens coaches work as performance and health coaches. Some are licensed medical doctors, but within the Program they do not diagnose, prescribe or issue sick notes, and no doctor-patient relationship is formed.
- If you are pregnant, have a medical condition or take medication, check with your doctor before you change your exercise, sleep or nutrition habits.
- Stop any activity that causes pain, dizziness or discomfort, and seek medical advice if needed.
- In an emergency, call your local emergency number (112 in the EU).
- You decide which suggestions you follow.
10. Your responsibilities
- Give accurate information when you register, and keep your contact details current.
- Keep your devices, wearable account and six-letter code secure. Do not share your code with others.
- Use the Program only for your own participation and in line with the law.
- Do not try to access other participants' data or interfere with Sapiens systems.
11. Intellectual property
All Program materials, including session content, worksheets and messages, belong to Sapiens or its licensors. You may use them for your own participation. You may not copy, sell or publish them without our prior written consent.
12. Third-party providers
The Program uses services from third parties, in particular wearable providers such as Oura, Garmin and Whoop. These providers offer their services and data "as is" and "as available". To the extent permitted by law, they give you no warranty through these terms, and they are not liable to you for any indirect, incidental, special or consequential damages arising from the Program. Sapiens is not responsible for the availability or accuracy of third-party services, or for changes the providers make to their apps or interfaces.
13. Liability of Sapiens
- Sapiens is liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law, such as product liability law, requires it.
- For slight negligence, Sapiens is liable only for breach of an essential contractual obligation, meaning an obligation whose fulfilment makes the Program possible and on which you may regularly rely. In that case, liability is limited to the damage typically foreseeable at the time of registration.
- Otherwise, Sapiens' liability for slight negligence is excluded.
- Sapiens is not liable for decisions or actions you take based on wellness suggestions, wearable scores or messages, except under the first point above.
14. Ending your participation
- You can leave the Program at any time by telling your coach or writing to support@be-sapiens.com. Please return any provided wearable.
- Sapiens may suspend or end your participation if you seriously breach these terms, or if Sapiens can no longer deliver the Program, for example because the Customer contract ends or a wearable provider stops its service.
- When your participation ends, Sapiens ends its access to your wearable data and deletes your data as described in the privacy policy.
15. Changes to these terms
We may update these terms when the Program, our providers or the law change. We inform active participants by message before a material change applies. If you do not agree, you can leave the Program.
16. Applicable law and disputes
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live also apply.
- Sapiens is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
- If any provision of these terms is invalid, the remaining provisions stay in force.
